Terms & Conditions – The Polanco Firm Directory & Websites

1. Agreement to These Terms

These Terms & Conditions (“Terms”) govern your access to and use of:

  • polancofirm.com
  • thepolancofirm.com
  • Any directories, listings, forms, or content we provide through these sites
    (collectively, the “Sites”).

By accessing or using the Sites, you agree to be bound by these Terms. If you do not agree, do not use the Sites.

These Terms form an agreement between you and Polanco Firm Association, d/b/a “The Polanco Firm” (“The Polanco Firm,” “we,” “us,” or “our”).

2. Not a Law Firm – No Legal Advice

The Polanco Firm is not a law firm and does not provide:

  • Legal advice
  • Legal representation
  • Attorney–client relationships

All content on the Sites, including directories, Guides, examples, and patterns, is for general informational and educational purposes only.

Nothing on the Sites:

  • Creates an attorney–client relationship between you and The Polanco Firm
  • Creates an attorney–client relationship between you and any listed attorney or organization
  • Is a substitute for advice from a licensed attorney in your jurisdiction

You should not act or refrain from acting based on any content on the Sites without consulting a qualified attorney about your specific circumstances.

3. Directory Listings and Referrals

The Sites may include directories of:

  • Attorneys and law offices
  • Legal aid organizations and nonprofits
  • Government agencies, courts, and complaint channels
    (collectively, “Directory Listings”).

Directory Listings are:

  • Provided for informational purposes only
  • Based on information supplied by the listed attorney or organization, or publicly available sources
  • Not guaranteed to be current, accurate, or complete

We do not:

  • Endorse, recommend, or certify any specific attorney, firm, organization, or agency
  • Guarantee that any listed party will respond, accept your case, or achieve any outcome
  • Participate in fee-splitting, pay-per-lead, or per-case referral arrangements

Any contact you make with a listed attorney or organization is at your own initiative and risk.
Any relationship, engagement, or fee agreement is solely between you and that attorney or organization.

4. Use of the Sites

You agree to use the Sites only for lawful purposes and in compliance with these Terms and any applicable laws.

You agree not to:

  • Use the Sites to harass, abuse, or harm others
  • Misrepresent your identity or affiliation
  • Attempt to scrape, mine, or collect data at a scale beyond normal browsing
  • Attempt to interfere with or disrupt the operation of the Sites
  • Upload or submit any content that is unlawful, defamatory, fraudulent, or infringing

We may suspend or terminate your access to the Sites at any time, without notice, if we believe you have violated these Terms or engaged in harmful behavior.

5. Submissions by Homeowners and Visitors

If you submit information through a homeowner intake form, contact form, or similar tool:

  • You represent that the information you provide is true and submitted in good faith to the best of your knowledge.
  • You understand that the Polanco Firm may review, categorize, and internally analyze your submission for pattern awareness and educational purposes.
  • Submission of a form does not guarantee a response, referral, or any particular outcome.

We may, but are not obligated to:

  • Follow up with clarifying questions
  • Provide references to public legal resources, legal aid, or directories
  • Decline to act on or respond to submissions that are incomplete, abusive, or outside our focus

6. Submissions by Attorneys and Organizations

If you submit information to be listed in a directory or to be considered for any “Attorney Partner” or membership program:

  • You represent that all information you provide (license, jurisdictions, practice areas, eligibility rules, etc.) is accurate and not misleading.
  • You agree to promptly notify us of any material changes (license status, practice focus, contact info, etc.).
  • You grant The Polanco Firm a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute the submitted content in connection with the Sites and directories.

We reserve the right, in our sole discretion, to:

  • Approve or decline any listing
  • Edit listing content for clarity, length, or format (without altering its core meaning)
  • Remove or suspend a listing at any time, with or without notice

Participation in any directory or membership program does not create a partnership, joint venture, or employment relationship between you and The Polanco Firm.

7. User Content and Reviews (If Enabled)

If the Sites later allow homeowners to submit reviews, feedback, or other user-generated content:

  • You are solely responsible for any content you post.
  • You must not post content that is unlawful, defamatory, harassing, infringing, or otherwise inappropriate.
  • You grant The Polanco Firm a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display that content in connection with the Sites.

We may, but are not obligated to:

  • Moderate, edit, or remove user content at our discretion
  • Disable or limit reviews for individual listings or for the directory as a whole

8. Intellectual Property

Unless otherwise noted, the Sites and their original content, including text, layout, design elements, and educational materials, are owned by or licensed to The Polanco Firm and are protected by copyright and other laws.

You may:

  • View and print content for your own personal, non-commercial use

You may not:

  • Reproduce, distribute, or publicly display substantial portions of the Sites without our prior written permission
  • Use our names, logos, or branding in a way that implies endorsement, sponsorship, or affiliation without consent

Attorneys, organizations, and agencies retain their own rights in logos, marks, or content they submit, subject to the license granted in Section 6.

9. Third-Party Sites and Links

The Sites contain links to third-party websites and services, including attorneys, legal aid organizations, agencies, and other resources.

We do not control and are not responsible for:

  • The content, policies, or practices of these third parties
  • The availability or operation of their websites or services

Your use of any third-party site is at your own risk and subject to that site’s own terms and policies.

10. Disclaimers

To the fullest extent permitted by law:

  • The Sites and all content are provided “as is” and “as available”, without warranties of any kind.
  • We do not warrant that the Sites will be uninterrupted, error-free, secure, or free of harmful components.
  • We make no guarantees about the accuracy, completeness, or timeliness of any Directory Listings or other content.

You are responsible for:

  • Evaluating any information on the Sites
  • Deciding whether and how to contact any listed attorney or organization
  • Obtaining appropriate legal advice from a licensed attorney about your own situation

11. Limitation of Liability

To the fullest extent permitted by law, in no event will The Polanco Firm or its affiliates be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of use, data, profits, or goodwill
  • Any damages resulting from or related to:
    • Your use of or inability to use the Sites
    • Your reliance on any content or Directory Listings
    • Any communications, engagements, or disputes between you and any attorney, law firm, organization, or agency listed or referenced on the Sites

In all cases, our total liability to you for any claims relating to the Sites will be limited to the amount, if any, that you paid us for use of the Sites during the 3 months prior to the event giving rise to the claim (often zero).

Some jurisdictions do not allow limitations of certain liabilities, so portions of this section may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless The Polanco Firm and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Sites
  • Your violation of these Terms
  • Any content or information you submit or post
  • Any dispute between you and a third party (including attorneys, firms, organizations, or agencies contacted via the Sites)

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page.

If you continue to use the Sites after changes are posted, you accept the updated Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Any disputes arising out of or relating to these Terms or the Sites shall be brought in the state or federal courts located in New York, and you consent to the personal jurisdiction of those courts.
